{"id":254,"date":"2018-04-04T21:42:07","date_gmt":"2018-04-04T21:42:07","guid":{"rendered":"http:\/\/exportcompliancesolutions.com\/blog\/?p=254"},"modified":"2018-04-04T21:42:07","modified_gmt":"2018-04-04T21:42:07","slug":"ear-amended-reflect-australia-group-decisions-dtag-meeting-penalty-inflation-adjustments","status":"publish","type":"post","link":"https:\/\/exportcompliancesolutions.com\/blog\/2018\/04\/04\/ear-amended-reflect-australia-group-decisions-dtag-meeting-penalty-inflation-adjustments\/","title":{"rendered":"EAR Amended to Reflect Australia Group Decisions; DTAG Meeting; More Penalty Inflation Adjustments"},"content":{"rendered":"<p><strong>Australia Group EAR Amendments<\/strong><\/p>\n<p>On April 2, 2018 (<a href=\"https:\/\/www.gpo.gov\/fdsys\/pkg\/FR-2018-04-02\/pdf\/2018-06581.pdf\">83 FR 13849<\/a>), the Department of Commerce amended the Export Administration Regulations (EAR) to revise the following Export Control Classification Numbers (ECCNs) based on 2017 Australia Group decisions:<\/p>\n<ul>\n<li>1C350 (toxic chemical agent precursors)<\/li>\n<li>1C351 (human and animal pathogens and toxins)<\/li>\n<li>1C353 (genetic elements and genetically-modified organisms)<\/li>\n<li>2B350 (chemical manufacturing facilities and equipment)<\/li>\n<li>2B351 (toxic gas monitors and monitoring systems)<\/li>\n<li>2B352 (equipment capable of use in handling biological materials)<\/li>\n<\/ul>\n<p>The specific changes, largely intended to clarify the entries, are detailed in the <a href=\"https:\/\/www.gpo.gov\/fdsys\/pkg\/FR-2018-04-02\/pdf\/2018-06581.pdf\">Federal Register Notice<\/a>.<\/p>\n<p>In addition, due to the <a href=\"http:\/\/www.australiagroup.net\/en\/india_statement.html\">admission of India to the Australia Group<\/a> in January, an international forum for harmonizing for chemical and biological export controls, the Country Commerce Chart (<a href=\"https:\/\/www.bis.doc.gov\/index.php\/documents\/regulations-docs\/federal-register-notices\/federal-register-2014\/1033-738-supp-1\/file\">Supplement No. 1 to part 738 of the EAR<\/a>) was revised to remove the \u201cX\u201d in India\u2019s entry for the CB 2 column (Chemical and Biological Weapons) and India was added to the Australia Group column (A:3) in the Country Groups chart (<a href=\"https:\/\/www.bis.doc.gov\/index.php\/documents\/regulation-docs\/452-supplement-no-1-to-part-740-country-groups\/file\">Supplement No. 1 to part 740 of the EAR<\/a>).<\/p>\n<p><strong>DTAG to Meet in May<\/strong><\/p>\n<p>The Defense Trade Advisory Group (DTAG) will meet on May 10, 2018 to discuss the following topics:<\/p>\n<ol>\n<li>Address one remaining task not briefed as final by the IT working group at the February 1 plenary meeting.
