{"id":335,"date":"2019-04-26T17:07:06","date_gmt":"2019-04-26T17:07:06","guid":{"rendered":"http:\/\/exportcompliancesolutions.com\/blog\/?p=335"},"modified":"2019-04-26T17:07:06","modified_gmt":"2019-04-26T17:07:06","slug":"finally-itar-government-exemption-expanded-opportunities-comment-contribute-future-export-controls","status":"publish","type":"post","link":"https:\/\/exportcompliancesolutions.com\/blog\/2019\/04\/26\/finally-itar-government-exemption-expanded-opportunities-comment-contribute-future-export-controls\/","title":{"rendered":"Finally\u2014ITAR Government Exemption Expanded \u2013 and Opportunities to Comment and Contribute to Future Export Controls"},"content":{"rendered":"<p><strong>State Department Expands \u00a7126.4 Government Exemption<\/strong><\/p>\n<p>On April 19, the Department of State, Directorate of Defense Trade Controls (DDTC) published a notice (<a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/FR-2019-04-19\/pdf\/2019-07696.pdf\">84 FR 16398<\/a>) that expands the International Traffic in Arms Regulations (ITAR) \u00a7126.4 licensing exemption for transfers made by or for an agency of the U.S. Government.\u00a0 A proposed rule was originally published in <a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/FR-2015-05-22\/pdf\/2015-12295.pdf\">2015<\/a> and this revision, <a href=\"http:\/\/exportcompliancesolutions.com\/blog\/2018\/11\/07\/export-compliance-updates-deccs-electronic-waste-wassenaar\/\">anticipated since last year<\/a>, was effective immediately.<\/p>\n<p>Notably, the new rule expands the exemption to include permanent exports, reexports, and retransfers.\u00a0 It also clarifies when it can be used by contractors, by third parties, or in international agreements or security cooperation programs.<\/p>\n<p><strong>Please Note:<\/strong> The phrase \u201cincluding technical data\u201d was removed from the exemption as \u201cdefense article\u201d is already defined at \u00a7120.6 to include technical data.\u00a0 The notice states that \u201cWhen the Department refers to defense articles, without modification, the reference includes technical data.\u201d<\/p>\n<p>Portions of the revised exemption (\u00a7126.4(a)(1) or (3) and (b)(1)) <em>may<\/em> be used for 126.1 countries.\u00a0 As revised, \u00a7126.1(a) includes a double negative: \u201cexemptions\u2026 except \u2026 \u00a7\u00a7126.4(a)(1) or (3) and (b)(1)\u2026 do not apply\u201d).\u00a0 As always, transactions involving 126.1 countries, even when the US government is involved, should be reviewed carefully and make sure to fully document their usage.\u00a0 No one wants to be in a position of having to recreate records after a period of time.<\/p>\n<p>Is this the same as the Export Administration Regulations (EAR) \u00a7740.11 GOV License Exception?\u00a0 Almost, as the revised \u00a7126.4 exemption has moved closer to, but does not completely mirror, the \u00a7740.11 GOV exception.\u00a0 The EAR exception has a different structure and more uses, including non-US governments and international organizations in some circumstances.\u00a0 Please read it carefully and the full text of the <a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/FR-2019-04-19\/pdf\/2019-07696.pdf\">Federal Register Notice<\/a> for additional background.<\/p>\n<p><strong>We Finally Have It!!!\u2014Be Sure to Review and Comment on Proposed DS-7788 Single Application Form<\/strong><\/p>\n<p>On April 19, 2019, the Department of State, Directorate of Defense Trade Controls (DDTC) published a notice (<a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/FR-2019-04-19\/pdf\/2019-07889.pdf\">84 FR 16554<\/a>) requesting comments on the proposed DS-7788 Application for the Permanent Export, Temporary Export, Temporary Import, or Brokering of Defense Articles, Defense Services, and Related Technical Data.\u00a0 The new form would consolidate existing forms including: DSP-5, DSP-61, DSP-73 and DSP-85 license applications;
