in a Pandemic \u2013 Updates from DDTC and OFAC"},"content":{"rendered":"<p><strong>DDTC Adjusts to Social Distancing<\/strong><\/p>\n<p>As we noted recently <a href=\"https:\/\/exportcompliancesolutions.com\/blog\/2020\/03\/20\/four-cs-export-compliance-updates-covid-19-cloud-country-groups-cfius\/\">on this blog<\/a>, the Department of State, Directorate of Defense Trade Controls (<a href=\"https:\/\/www.pmddtc.state.gov\/ddtc_public?id=ddtc_public_portal_homepage\">DDTC<\/a>) remains open, but will be making adjustments in response to the Coronavirus Disease 2019 (COVID-19) pandemic.\u00a0 This includes an electronic process for submitting disclosures to the office of Defense Trade Controls Compliance (DTCC).<\/p>\n<p>Since that announcement, DDTC has:<\/p>\n<ul>\n<li>Cancelled its Wednesday, April 29 In-House Seminar<\/li>\n<li>Suspended pick-up\/drop off courier services while continuing to send and accept U.S. mail<\/li>\n<li>Indicated that it is considering a one-time temporary reduction in registration fees for \u201ccertain categories of DDTC registrants\u201d<\/li>\n<li>Implemented procedures to send DSP-85 and General Correspondence (GC) responses by email when possible<\/li>\n<li>Began accepting FMS Part 130 reports via email at DDTC-Part130Notices@state.gov<\/li>\n<li>Moved to electronic submissions of Congressional Notifications.<\/li>\n<\/ul>\n<p>DDTC has also provided extensions as follows:<\/p>\n<ul>\n<li>Temporarily extended ITAR registrations expiring on February 29 through June 30, 2020 for two months from the original date of expiration<\/li>\n<li>Extended licenses expiring \u201cbetween March 13, 2020 and May 31, 2020 for six (6) months from the original date of expiration\u201d<\/li>\n<li>Granted an additional 30 days for responses to request-for-information letters related to DTCC disclosures.<\/li>\n<\/ul>\n<p>Finally, DDTC made the following announcements to address remote working and expedited licenses:<\/p>\n<ul>\n<li>Suspended \u201cthe requirement that a regular employee, for purposes of ITAR \u00a7 120.39(a)(2), work at the company\u2019s facilities, to allow the individual to work at a remote work location, so long as the individual is not located in Russia or a country listed in ITAR \u00a7 126.1\u201d through July 31, 2020.<\/li>\n<li>Suspended a similar requirement for regular employees of licensed entities working under a TAA, MLA, or exemption.<\/li>\n<li>Reissued guidance for requests submitted in support of U.S. Operations (<a href=\"https:\/\/pmddtc.state.gov\/sys_attachment.do?sys_id=24cb25eedbd854505564ff1e0f9619e3&amp;sysparm_referring_url=tear_off&amp;view=true\">USOP<\/a>) (exports in support of U.S. and coalition forces that are deployed or scheduled to be deployed within 90 days).<\/li>\n<\/ul>\n<p>Please monitor the <a href=\"https:\/\/www.pmddtc.state.gov\/ddtc_public?id=ddtc_public_portal_homepage\">DDTC website<\/a> for additional announcements.<\/p>\n<p><strong>OFAC Publishes Pandemic Guidance<\/strong><\/p>\n<p>On April 20, 2020, the Department of the Treasury, Office of Foreign Asset Control (OFAC) <a href=\"https:\/\/www.treasury.gov\/resource-center\/sanctions\/OFAC-Enforcement\/Pages\/20200420.aspx\">released a statement<\/a> on compliance concerns during the COVID-19 pandemic.<\/p>\n<p>The announcement addresses exemptions and authorizations that allow humanitarian assistance to countries subject to OFAC sanctions.\u00a0 It specifically addresses the Iran, Venezuela, North Korea, Syria, Cuba, and Ukraine\/Russia sanctions programs.<\/p>\n<p>OFAC also requests anyone affected by the pandemic to contact OFAC as soon as practicable if delays associated with OFAC\u2019s regulatory requirements (e.g., various reporting requirements and responding to administrative subpoenas).<\/p>\n<p>OFAC has also established an e-mail account for electronic submission of disclosures at <a href=\"mailto:OFACdisclosures@treasury.gov\">OFACdisclosures@treasury.gov<\/a>.\u00a0 OFAC has previously published <a href=\"https:\/\/www.treasury.gov\/resource-center\/sanctions\/OFAC-Enforcement\/Documents\/ofac_data_delivery.pdf\">specific guidance<\/a> on how to organize and submit electronic correspondence.<\/p>\n<p>Finally, OFAC acknowledged that the pandemic \u201ccan cause technical and resource challenges for organizations\u201d that will be evaluated as a factor in potential violations on a case-by-case basis.<\/p>\n<p><strong>Compliance During the Pandemic \u2013 ECS Can Help<\/strong><\/p>\n<p>The U.S. government offices are making efforts to alleviate some difficulties in dealing with them, but this is not an excuse to ignore export compliance.\u00a0 Enforcement may be hampered now, but any compliance problems left to fester are just going to get worse for when they
