Regulatory and Policy Update Roundup: December 2025"},"content":{"rendered":"<p><strong>BIS 50% Beneficiary Rule Suspended<\/strong><\/p>\n<p>On November 12, 2025, the Department of Commerce, Bureau of Industry and Security, published a rule (<a href=\"https:\/\/www.federalregister.gov\/documents\/2025\/11\/12\/2025-19846\/one-year-suspension-of-expansion-of-end-user-controls-for-affiliates-of-certain-listed-entities\">90 FR 50857<\/a>) suspending the <a href=\"https:\/\/exportcompliancesolutions.com\/blog\/2025\/10\/28\/50-rule-for-entity-list-shutdown-updates-and-more\/\">previously announced<\/a> \u201c50% Rule\u201d for the <a href=\"https:\/\/ecscreening.com\/index.php\/blog\/28-know-your-sanctions-lists-the-entity-list\">Entity List<\/a> and <a href=\"https:\/\/ecscreening.com\/index.php\/blog\/65-new-commerce-and-ofac-sanctions-lists-include-communist-chinese-military-companies-entity-list-expanded\">Military End User (MEU) List<\/a>.<\/p>\n<p>Originally scheduled to take effect with the expiration of a General License on November 28, 2025, the rule is now suspended for a year \u2013 through November 9, 2026.\u00a0 Given the importance of this rule, companies should continue to work on implementing additional screening and due diligence measures on exporters and suppliers.\u00a0 Keep in mind that restrictions also ELISA website that previously provided tracking for pending ITAR applications has been replaced with <a href=\"https:\/\/usxports.gov\/usx\">usxports.gov<\/a>.\u00a0 The new site is intended to provide a unified case search for applications submitted through DDTC\u2019s DECCS and BIS\u2019s SNAP-R licensing systems.\u00a0 ELISA has been decommissioned, while BIS\u2019s <a href=\"https:\/\/snapr.bis.gov\/stela\">STELA<\/a> (System for Tracking Export License Applications) remains online.<\/p>\n<p><strong>Cambodia Removed from ITAR \u00a7 126.1<\/strong><\/p>\n<p>Following <a href=\"https:\/\/exportcompliancesolutions.com\/blog\/2025\/10\/31\/cambodia-arms-embargo-to-end\/\">our previous report<\/a> that Cambodia would be removed from the ITAR 126.1 list of prohibited destinations, the Department of State, Directorate of Defense Trade Controls (DDTC) published a rule (90 FR 50489, November 7, 2025) officially making that change.<\/p>\n<p>As stated in the rule:<\/p>\n<p style=\"padding-left: 40px;\">As a result of this change, requests for authorization for transfers of defense articles and defense services to Cambodia will be adjudicated on a case-by-case basis and exemptions that are unavailable for transfers to countries listed in ITAR \u00a7\u2009126.1 are now available for transfers to Cambodia, subject to the relevant criteria in the exemption being satisfied.<\/p>\n<p><strong>\u00a0<\/strong><strong>Tri-Seal Advisory: Sanctions and Export Controls Relief for Syria<\/strong><\/p>\n<p>On November 10, 2025, the Department of State, Department of Commerce, and the U.S. Department of the Treasury\u2019s Office of Foreign Assets Control (OFAC) <a href=\"https:\/\/content.govdelivery.com\/accounts\/USTREAS\/bulletins\/3fad4d0\">issued<\/a> a\u00a0Tri-Seal Advisory: Sanctions and Export Controls Relief for Syria.\u00a0 The advisory provides an overview of what business is currently permissible with Syria as well as what sanctions and other restrictions remain in place.\u00a0 While some sanctions on specific persons and entities remain in place, Syria is no longer subject to comprehensive sanctions.\u00a0 Many civilian items (EAR99) may generally be exported without a license, but most Commerce Control List (CCL) items require a license.\u00a0 The advisory (<a href=\"https:\/\/ofac.treasury.gov\/media\/934736\/download?inline\">pdf<\/a>) contains additional detail on the current restrictions and
