{"id":574,"date":"2026-09-18T16:43:23","date_gmt":"2026-09-18T20:43:23","guid":{"rendered":"https:\/\/exportcompliancesolutions.com\/blog\/?p=574"},"modified":"2026-09-18T16:44:01","modified_gmt":"2026-09-18T20:44:01","slug":"export-regulatory-and-policy-update-roundup-september-2026","status":"publish","type":"post","link":"https:\/\/exportcompliancesolutions.com\/blog\/2026\/09\/18\/export-regulatory-and-policy-update-roundup-september-2026\/","title":{"rendered":"Export Regulatory and Policy Update Roundup: September 2026"},"content":{"rendered":"<p><b>BAE Consent Agreement Published<\/b><\/p>\n<p><span style=\"font-weight: 400;\">On July 8, 2026, BAE Systems, Inc. entered into a consent agreement with the Department of State, Directorate of Defense Trade Controls (DDTC).\u00a0 This agreement settled allegations of ITAR violations, including unauthorized exports and retransfers, unauthorized furnishing of defense services, and violations of terms, conditions, and provisos of DDTC authorizations.\u00a0 The agreement includes a $36 million civil penalty and strengthened compliance policies, procedures, and training under a Special Compliance Officer (SCO).<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The charging letter, agreement, and order are posted on the <\/span><a href=\"https:\/\/deccs.pmddtc.state.gov\/ddtc_public?id=ddtc_kb_article_page&amp;sys_id=384b968adb3cd30044f9ff621f961941\"><span style=\"font-weight: 400;\">DDTC website<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><b>BIS Eases UAE Export Controls<\/b><\/p>\n<p><span style=\"font-weight: 400;\">On July 14, 2026, the Department of Commerce, Bureau of Industry and Security (BIS) issued a rule (<\/span><a href=\"https:\/\/www.federalregister.gov\/documents\/2026\/07\/14\/2026-14132\/enhanced-favorable-treatment-for-the-united-arab-emirates-under-the-export-administration\"><span style=\"font-weight: 400;\">91 FR 43034<\/span><\/a><span style=\"font-weight: 400;\">) enhanced favorable treatment for the United Arab Emirates (UAE) under the Export Administration Regulations (EAR).\u00a0 The UAE was removed from Country Groups D:3 (Chemical &amp; Biological) and D:4 (Missile Technology) and added to Country Group A:5.\u00a0 As a result, additional license exceptions including Strategic Trade Authorization (STA) and improved access to access to advanced computing items will be available for UAE.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">BIS also published a <\/span><a href=\"https:\/\/www.bis.gov\/press-release\/department-commerce-eases-export-controls-uae\"><span style=\"font-weight: 400;\">press release<\/span><\/a><span style=\"font-weight: 400;\"> on this action.<\/span><\/p>\n<p><b>State Sponsor of Terrorism Determination Regarding Syria Rescinded<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Continuing the trend of relaxed controls on Syria, on August 31, 2026 (<\/span><a href=\"https:\/\/www.federalregister.gov\/documents\/2026\/08\/31\/2026-17653\/rescission-of-the-state-sponsor-of-terrorism-determination-regarding-syria\"><span style=\"font-weight: 400;\">91 FR 55965<\/span><\/a><span style=\"font-weight: 400;\">), the Department of State rescinded Syria\u2019s State Sponsor of Terrorism Determination originally issued December 29, 1979.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Syria remains on the ITAR 126.1 prohibited destination list and Country Group E:1 (terrorist supporting countries) under the Export Administration Regulations.\u00a0 It is also subject to country-specific license requirements under <\/span><a href=\"https:\/\/www.ecfr.gov\/current\/title-15\/subtitle-B\/chapter-VII\/subchapter-C\/part-746#746.9\"><span style=\"font-weight: 400;\">EAR \u00a7 746.9<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0 Further updates should be expected.<\/span><\/p>\n<p><b>Cyprus \u00a7 126.1 Waiver Renewed<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Cyprus remains in the unique situation of being found in the ITAR \u00a7 126.1 list of proscribed destinations, but with an annually suspended status. \u00a0 On September 11, 2026, DDTC published a rule (<\/span><a href=\"https:\/\/www.federalregister.gov\/documents\/2026\/09\/11\/2026-18630\/amendment-to-the-international-traffic-in-arms-regulations-prohibited-exports-imports-and-sales-to\"><span style=\"font-weight: 400;\">91 FR 57787<\/span><\/a><span style=\"font-weight: 400;\">)\u00a0 suspending\u00a0 Republic of Cyprus&#8217; status as a proscribed destination through September 30, 2027 (Fiscal Year 2027).<\/span><\/p>\n<p><b>Silencers Move from USML to CCL<\/b><\/p>\n<p><span style=\"font-weight: 400;\">On July 23, 2026, DDTC and BIS published a pair of rules (<\/span><a href=\"https:\/\/www.federalregister.gov\/documents\/2026\/07\/23\/2026-14943\/international-traffic-in-arms-regulations-usml-category-i-firearm-suppressors\"><span style=\"font-weight: 400;\">91 FR 46279<\/span><\/a><span style=\"font-weight: 400;\"> and <\/span><a href=\"https:\/\/www.federalregister.gov\/documents\/2026\/07\/23\/2026-14942\/implementation-of-ear-export-controls-on-silencers-mufflers-and-sound-suppressors-and-other-firearms\"><span style=\"font-weight: 400;\">91 FR 46252<\/span><\/a><span style=\"font-weight: 400;\">) moving silencers, mufflers, and sound suppressors for non-automatic and semi-automatic firearms from USML Category I(e) to the Commerce Control List under Export Control Classification Numbers (ECCNs) 0A501.f and 0A502.f effective November 20, 2026.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The change was based on a determination that the items do not \u201cprovide a critical military or intelligence advantage or, in the case of weapons, have an inherently military function.\u201d\u00a0 Silencers, mufflers, and sound suppressors specially designed for fully automatic firearms will remain on the USML.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">BIS also published a <\/span><a href=\"https:\/\/www.bis.gov\/press-release\/department-commerce-streamlines-export-controls-sound-suppressors\"><span style=\"font-weight: 400;\">press release<\/span><\/a><span style=\"font-weight: 400;\"> on this action.<\/span><\/p>\n<p><b>USML Category XI(b) Extended for Two Years<\/b><\/p>\n<p><span style=\"font-weight: 400;\">On August 28, 2026, DDTC published a rule (<\/span><a href=\"https:\/\/www.federalregister.gov\/documents\/2026\/08\/28\/2026-17576\/international-traffic-in-arms-regulations-extension-of-temporary-modification-of-category-xib-of-the\"><span style=\"font-weight: 400;\">91 FR 55461<\/span><\/a><span style=\"font-weight: 400;\">) continuing the current text controlling intelligence-analytics software in USML Category XI(b).\u00a0 The previous extension had been announced in 2021, anticipating a wholesale revision of the category expected by 2026.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Export Control Reform measures were originally scheduled to remove \u201csoftware\u201d from XI(b) as well as the capability to analyze and produce information from the electromagnetic spectrum.\u00a0 Some software would remain controlled under XI(d).\u00a0 Based concerns that a revised category would no longer clearly control \u201ccertain intelligence-analytics software,\u201d DDTC has continued to \u201camend\u201d XI(b) to maintain the original text.<\/span><\/p>\n<p><b>USML Revised to Exclude Civil Aircraft with Survivability Equipment<\/b><\/p>\n<p><span style=\"font-weight: 400;\">On August 28, 2026, DDTC published an interim final rule (<\/span><a href=\"https:\/\/www.federalregister.gov\/documents\/2026\/08\/28\/2026-17660\/international-traffic-in-arms-regulations-modification-of-civil-aircraft-to-incorporate-aircraft\"><span style=\"font-weight: 400;\">91 FR 55457<\/span><\/a><span style=\"font-weight: 400;\">) excluding survivability-enhanced aircraft from USML Category VIII(a)(8).<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Effective October 13, 2026, a definition of Aircraft Survivability Equipment (ASE) will be added to ITAR \u00a7 121.0 along with an exclusion from the definitions of exports, reexports, and retransfers in \u00a7 120.54.\u00a0 ASE will remain controlled under USML Category XI(a)(4), but \u201csecured ASE\u201d will not automatically subject aircraft to authorization requirements.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">As noted in the rule:<\/span><\/p>\n<blockquote><p><span style=\"font-weight: 400;\">\u201cASE specifically refers to directed infrared countermeasures (DIRCM) and infrared or ultraviolet missile warning systems necessary for the operation of DIRCM. Survivability-enhanced aircraft are often used to mitigate risk in the transport of passengers or goods, in various threat environments. These aircraft incorporate ASE described on the USML to protect the aircraft and its occupants from man-portable air defense systems (MANPADS) and other guided weapons that can pose a serious threat to aircraft.
